The recently-enacted and amended Nebraska Healthy Families and Workplaces Act (“Act”) requires, among other things, that covered employers give employees written notice regarding the Act’s requirements by September 15, 2025 and at the commencement of employment thereafter.  In addition, the Act mandates that covered employers display a poster that requires the information required in the employee notice.

Recently the Nebraska Department of Labor published a model employee notice and poster for employers to use.

It is important to note that the model employee notice and poster are in English.  However, employers are also obligated to create and distribute a notice and poster in any other language that is “the first language spoken by at least five percent of the employer’s workforce if [Nebraska DOL] has provided posters in such language.”  It is anticipated that a Spanish-version of the model employee notice and poster will be issued before the September 15th deadline.

Employers should consider implementing the poster and revising their employee handbooks prior to the September 15th deadline.
